Yamato appeals court ruling favoring Japan Post parcel service

Yamato Transport Co. appealed to the Tokyo High Court on Wednesday against a lower court’s dismissal of the company’s request for an injunction on the parcel delivery service Japan Post is offering in a tie-up with convenience store operator Lawson Inc.

On Jan. 19, the Tokyo District Court rejected Yamato’s claim, filed in September 2004, that the Japan Post service poses unfair competition. Yamato is a parcel delivery company and the core unit of Yamato Holdings Co.

The district court ruled that the public postal concern is not charging prices below cost because the growth of its delivery service has not pushed it deeper into the red.

Yamato recorded higher sales and profits even after Japan Post lowered its service charges, so the postal company’s service is not growing at the expense of Yamato’s, the district court said.
