US Astar seeks sanctions on UPS, FedEx

Astar Air Cargo is seeking sanctions against rivals Federal Express and United Parcel Service for making what it described as “unsupported and deceptive claims” in a recent motion they filed with the U.S. Department of Transportation In a pleading filed with an administrative law judge on Friday, Astar contended that requests by its two U.S. rivals are part of a coordinated FedEx-UPS campaign to protect their current stronghold in the U.S. express delivery marketplace.

“FedEx and UPS have blatantly misrepresented the contents of the documents they seek to have admitted,” Astar, formerly known as DHL Airways, told Burton Kolko, the judge.

Astar did not specify the sanctions it is seeking against its rivals, saying it was leaving that to the discretion of the judge.

David Bolger, a UPS spokesman, said Astar has previously asked the judge to impose sanctions on it and FedEx. “This is one of the arrows in Mr. Litvack’s quiver,” he said, referring to Astar attorney Sanford Litvack.

FedEx and UPS contend that Deutsche Post World Net and DHL International illegally control Astar.
