France before the Court over the non-implementation of two postal Directives

The European Commission has decided to refer France to the European Court of Justice to ensure it fully implements the two EU postal services Directives. The first Directive dates from 1997 and among other things requires Member States to appoint a national postal regulator legally and operationally separate from the postal operators. The second Directive, adopted in 2002, commits Member States to gradually open certain sectors of their postal markets to competition. The Commission has at the same time decided to close infringement cases against Belgium, which has now adopted a law establishing an independent regulator as required by the first Directive and against Greece and Austria, which have notified the Commission that they have put in place the market opening measures stipulated by the second Directive.

Belgium Post and Western Union in talks

Belgium’s postal service is talking with Western Union, the money-transfer business of First Data, about a possible partnership as it looks for ways to turn a profit, a local daily reported on Friday. The struggling De Post/La Poste saw such a partnership as a way to improve the profitability of its network of branch offices, the daily L’Echo said. “We are talking with Western Union and with other companies of the same type, but we still have not taken any decision about developing a money transfer business,” it quoted a Post spokesman as saying.

European Commission intends to exempt REIMS II from the antitrust rules but requires third party access

Today, the Commission published a notice in the Official Journal inviting third parties to submit their comments on the so-called Agreement for the Remuneration of Mandatory Deliveries of Cross-Border Mails (REIMS II). REIMS II is an agreement on the remuneration that public postal operators (PPOs)° pay each other for the delivery of incoming cross-border mail. This remuneration is also referred to as “terminal dues”. Seventeen PPOs from the European Union and the EEA are parties to the REIMS II agreement. After receiving the comments of interested third parties to be submitted one month after publication of the OJ the Commission will take a final decision on whether the system of terminal dues can be exempted from the antitrust rules. The Commission will also decide on the length of the exemption to be granted.

La Poste Belgium closes a difficult financial year 2001

La Poste S.A.’s current earnings for 2001 amount to 42.6 million euros, significantly down on 2000. This result is due, on the one hand, to a very modest growth in turnover and, on the other hand, to a considerable increase in costs for both personnel and IT. After posting the extraordinary income, financial year 2001 of La Poste S.A. shows a net profit available for distribution of 38.4 million euros.
