Consignia takes Hays to law

LONDON (AFX) – Consignia on Monday night initiated legal proceedings against
Hays PLC seeking remedies for an alleged infringement of its exclusive rights to
certain postal delivery services, Hays said, adding that it will “vigorously”
defend its position.
The services in question relate mainly to the delivery of tickets,
itineraries and invoices, between travel companies and their respective branches
and agents.
The court hearing will take place on Firday, July 6.
Hays executive director Graham Williams told AFX News that, should Consignia
be successful, it would only be able to temporarily stop Hays from providing
this service as Hays has applied to the Postal Services Commission for the niche
license covering this service, should this actually prove to be a reserved
service.
“The licenses are due to be issued by the early autumn so Consignia is
trying to stop us for just one or two months,” he said.
Williams, who said the court case affects 10 mln stg of Hays annual turnover
, said Hays will argue that these services are not covered by Consignia’s de
facto postal monopoly. He said he does not know how much Consignia is seeking in
compensation.
In a statement, Neil Tregarthen, managing director at Hays Mail & Express
Services, commented: “Hays believes that Consignia’s attempts through the Court
to stop such services are anti-competitive, against the interests of the
business community and contrary to the spirit of both UK and European
legislation which is seeking to promote competition.”
