FedEx drivers wrongly classified as independent contractors, NLRB rules

In the latest of a series of decisions exposing FedEx Ground’s driver misclassification tactics, The National Labor Relations Board (NLRB) has ruled that 23 FedEx drivers in Northboro, Massachusetts, are employees and not, as FedEx wrongly contends, independent contractors. The drivers who work for FedEx Home Delivery (FHD), a division of FedEx Ground, are seeking union representation from Teamsters Local 170 in Worcester, Massachusetts. The decision clears the way for the workers to hold an election in the next month. The ruling is yet another big setback for the company, which has been misclassifying drivers to avoid paying taxes and overtime, and to prevent workers from forming a union. “This decision sends a clear message to FedEx Ground – stop misclassifying your workers to fatten your bottom line,” said Teamsters General President Jim Hoffa. “These workers deserve health and welfare benefits, competitive wages and a voice in the workplace.”

DHL to invest USD 9.5 Mln to expand operation centres in Mexico

The global carrier and package delivery company DHL, through its Mexican unit, DHL Mexico, will invest 100 mln Mexican pesos (UDD9.56 mln/7.92 mln euro) to expand and modernise its operation centres in Mexico, the vice president of operations of DHL Mexico, Luis Erana, said on February 1, 2006. The investment will be allocated for the five operation centres of DHL in Mexico, among them those in Mexico City, Guadalajara and Monterrey. DHL has been operating in Mexico for the last 27 years, it has 400 sales points and has so far created 3,000 direct and 1,000 indirect jobs in the country.

FedEx expands in Middle East

FedEx has introduced a new service to Libya and Algeria through a network of Global Service Participants (GSPs). In Libya Fedes will work with Al Zajel Express as its GSP. Four offices have already been etablished by the GSP in the major Libyan cities to suppot cutomers across the country. In Algeria, FedEx service will be provided by GSP Falcon Express Inc, which already handles delivery services for FedEx in Jordan, Lebanon, Qatar, Syria and Yemen.

Yamato appeals court ruling favoring Japan Post parcel service

Yamato Transport Co. appealed to the Tokyo High Court on Wednesday against a lower court’s dismissal of the company’s request for an injunction on the parcel delivery service Japan Post is offering in a tie-up with convenience store operator Lawson Inc. On Jan. 19, the Tokyo District Court rejected Yamato’s claim, filed in September 2004, that the Japan Post service poses unfair competition. Yamato is a parcel delivery company and the core unit of Yamato Holdings Co. The district court ruled that the public postal concern is not charging prices below cost because the growth of its delivery service has not pushed it deeper into the red.
