U.S., Mexico Attempt to Quell UPS Lawsuit

The governments of the United States and Mexico have lined up behind Canada in an attempt to throw out a $230-million suit brought by United Parcel Service over what it says are unfair business practices by Canada Post Corp. The three governments argue in filings before a NAFTA tribunal that UPS’s claim does not come under the scope of the trade agreement’s controversial Chapter 11, which allows firms to sue any of the three countries if they feel they have been hurt by government actions. UPS in turn accuses the governments of trying to rewrite the chapter without going through the national legislatures of the three countries as another NAFTA provision requires. The case has wider ramifications than just whether, as UPS alleges, Canada Post has cost it at least $230-million in damages by channelling monopoly revenue from the general postal service into subsidizing Canada Post courier products.

Mexico’s postal service looks to monopoly as a solution to its financial woes

You can’t blame them for trying. The Mexican Postal Service (Sepomex) first began losing money in 1999, but by 2000, losses were reaching $200 million pesos a year, and $600 million pesos in 2001.

But now, the state-owned company is crying foul over what it calls “illegal competition” from well-known private foreign and domestic courier companies. The massive influx of competition has been further exasperated by the increasing popularity of email. In the face of its imminent demise Sepomex, the Transport and Communications Secretariat has sent a controversial reform proposal to the Chamber of Deputies that has private courier companies barking mad. The proposal would consolidate Sepomex’s position within the market and so assure its survival, that has companies like Multipack, DHL, Fedex and UPS barking mad.

Sepomex forced to face unfair competition from postal companies

The unfair competition of around 6,000 postal companies has hit Servicio Postal Mexicano (Sepomex – Mexican Postal Service) very hard as it has lost 40% of corporate clients and lost income of 500 million pesos (US$52.6 million) per year, reported Santiago Ontaón, director of operations.One of Sepomex’s competitors is Servicio Continental de Mensajera (SCM), which has managed to grab clients such as Bancomer, “the second most important client in the Mexican postal system,” said Ontaón. Bancomer alone has 6.5 million account holders.

Mexican Postal Law Concerns Business Group

If the modifications to the Postal Law granting autonomy to the Mexican Postal Service (Sepomex) are passed, it would mean the continuity of mail services, which will make the country to lose competitiveness at international level, said Claudio X. González, president of the Business Coordination Council (CCE). González said that the CCE was worried about the future reforms to Sepomex because they are contrary to the Competition Law since it limits the actions of courier services by grating autonomy to postal management.
